Lei n.º 153/2015 · Artigo 20.º and annex

What a Portuguese valuation report must contain

The annex sets the mandatory content in three blocks. The building's condition is a required line inside it. What the report is never asked to establish sits on the right.

Required by law
In the valuation report
Anexo, block B, first item
  • Location characteristics of the property
  • Estado de conservação, the recorded state of the fabric
  • Type of construction
  • Use to which the property is put
  • Identification elements, and accountability elements naming the perito
Outside the exercise
Left unexamined
No instrument requirement, no comparison duty
  • Cause of a recorded defect, and how far it has travelled
  • Built footprint measured against the approved drawings
  • Whether works on the plot carry municipal authorisation
  • Condition of concealed elements: structure, wiring, services
  • What putting any finding right would cost
The distinction that mattersThe condition line exists to support a value. A perito records that a roof is in poor condition because poor condition changes the figure, and stops there. The questions that follow need instruments, and the Portuguese purchase asks them of nobody.
