Tenancy status verified
Request sight of any current lease agreements. Check registo predial for registered tenancies. Confirm with seller in writing whether property is currently occupied by a tenant.
ARU zone status confirmed
Check property address against municipal ARU zone maps. For Lisbon: Lisboa Interactiva. For Porto: CMP planning. For other municipalities: contact the camara municipal directly.
Heritage classification checked
Check SIPA database at patrimoniocultural.gov.pt. Verify both the property's own classification status and its proximity to classified buildings and their protection perimeters.
Co-ownership structure reviewed
Review caderneta predial and certidao de registo predial for any shared ownership or fractional interests. Relevant for inherited properties or properties acquired jointly.
Seller warranty in CPCV
CPCV to include seller warranty confirming all preferencia holders identified, all notifications made, and no right exercised or declared. Backed by specific indemnity for buyer's losses.
All notification periods expired before escritura
Confirm that the 30-day notification period for any preferencia holder has fully expired before proceeding to the escritura. A notification made but not yet expired creates ongoing risk.
Post-escritura challenge window
A preferencia holder who was not correctly notified can bring an accao de preferencia for up to 2 years from registration of the land transfer. A completed purchase is not safe from preferencia challenge until this period has passed. Independent legal verification before the CPCV is the primary protection.
