When an area difference stops the sale

Article 28.º-A of the Código do Registo Predial waives harmonisation where the difference against the larger figure stays inside these thresholds. Above them, correction becomes mandatory before a clean transfer.

Property typeToleranceMeasured against
Urban property and building land 10% The larger of the two recorded figures
Rural property without geometric cadastre 20% The larger of the two recorded figures
Rural property with geometric cadastre 5% The larger of the two recorded figures

Inside the tolerance

The tax record and the land registry may disagree and the sale proceeds without correction.

A difference inside the threshold is still worth reading. It is sometimes a clerical entry from decades ago and sometimes the trace of a work nobody declared, and the two look identical on paper.

Above the tolerance

Harmonisation is mandatory, and it runs in a fixed order:

  1. Topographic survey by a licensed engineer, architect or surveyor
  2. Rectification at the Autoridade Tributária, via Modelo 1 do IMI for urban property
  3. Registry rectification at the Conservatória, accepted only once the updated Caderneta Predial exists
Why the timing matters. The sequence crosses two agencies and a declaration from adjoining owners is usually required. Months, not weeks. A discrepancy found after the promissory contract is signed can push a financed purchase past its own deadline with the deposit already committed.
