Which paperwork should exist, and from when

A building's construction date decides which documents should be in the file. The purchase date decides who is expected to check them.

Before 7 August 1951

Conditional exemption from a use licence

The Regulamento Geral das Edificações Urbanas commenced on this date. Construction predating it needs no use licence, provided no reconstruction, extension, alteration or change of use has followed. Conservation works alone leave the exemption intact.

Decreto-Lei n.º 38382, de 7 de agosto de 1951

From 7 August 1951

Use licence required

Issued by the Câmara Municipal, naming the authorised use and the version of the building it was granted against. Later works need their own authorisation and their own updated licence.

RJUE, Decreto-Lei n.º 555/99, de 16 de dezembro

From 30 March 2004

Ficha Técnica da Habitação required

Applies to anything built, reconstructed or extended after this date. The duty to produce the document survived 2024 even though the handover at the deed did not.

Decreto-Lei n.º 68/2004, de 25 de março

1 January 2024 · in force now

The licence stops being a deed requirement

The notary no longer verifies urban-planning legality, and the Ficha Técnica is no longer handed over at the deed. The obligation on the building survives. The check on it does not.

Decreto-Lei n.º 10/2024, de 8 de janeiro

1 October 2026 · not yet in force

The seller states the title position

Sale documents must state the situation of the urbanistic title: presented, claimed but not exhibited, or not held. Omitting the mention makes the transaction anulável.

Decreto-Lei n.º 108/2026, de 29 de maio, commencement deferred by Decreto-Lei n.º 155-B/2026, de 31 de julho

Three readings that circulate and are wrong

The date. DL 108/2026 does not enter force on 3 August 2026. DL 155-B/2026 deferred it to 1 October 2026, and the earlier date is still printed widely.

The attribution. Municipal verification was removed from the deed by DL 10/2024 on 1 January 2024. DL 108/2026 adds a disclosure duty back rather than taking one away.

The consequence. Voidability attaches to leaving the mention out of the document, not to the property lacking a title. Nothing in the diploma requires an inspection.
