What an unauthorised work costs, and who ends up carrying it

The fine is the visible number and rarely the largest one. The obligation attaches to the property, so it transfers at the deed with everything else.

Legalisation

Where a route exists. Drawings, technical responsibility statements, a municipal file and the taxas set by each municipality's own regulation. Cost and duration vary by municipality and by the scale of the work, and no national figure describes it.

Correction or demolition

Where no route exists. Works breaching the Plano Diretor Municipal, encroaching on a boundary or sitting in a protected area may not be legalisable. Municipal supervision does not expire and can act years after a sale.

Financing and resale

The cost buyers meet first. Lenders remain free to ask for the licence and many still do, and the next buyer running the same checks will find the same gap and price it.

The obligation follows the property

An unauthorised work created by a previous owner does not stay with that owner. Once the deed completes, the municipality enforces against the person holding the property, which is the buyer. Finding the work before the promissory contract is what keeps it a negotiation rather than a bill.
