Before 2024, the habitation licence was verified at the deed. The Simplex Urbanístico removed that requirement. Today, nobody verifies on the buyer's behalf. Without an inspection, the buyer is the one who discovers (and pays for) those defects.

What buyers need to know
- Ideally, before signing the promissory contract. The report gives you concrete information to negotiate the price, demand repairs, or include exit clauses. If you've already signed, the inspection is still valuable; it can support negotiation and ensure you go into the deed fully informed.
- Yes. This is one of the most common uses. If the report identifies defects (water infiltration, non-compliant electrical installation, structural cracks), you have an objective technical basis to renegotiate the price or require repairs before signing.
- Yes, it is legally mandatory (DL 101-D/2020) in any sale or rental transaction. Many banks require class C or above to qualify for green mortgage rates. Properties rated D or below may result in higher interest rates or financing difficulties.
- The Simplex Urbanístico removed the requirement for a habitation licence at the time of the deed. Previously, the notary verified that the property had a valid licence. Now they don't. The responsibility to confirm that the property is legal, compliant and free of irregularities has shifted entirely to the buyer.
