Terms of Service
These Terms of Service govern the relationship between InspectOS ("InspectOS", "we", "us") and any person or organisation ("Client", "you") who uses our website or books an inspection service. By placing a booking, you confirm that you have read and accepted these Terms in full.

1. About InspectOS
InspectOS is a Portuguese building intelligence company providing professional building inspection, energy certification, and regulatory compliance services for the Portuguese real estate market. We bridge the liability gap created by Simplex Urbanístico (Decree-Law 10/2024), restoring the independent verification that buyers no longer receive by law.

2. Services
InspectOS offers the following services. All prices are inclusive of Portuguese VAT:
- Simplex Safe — forensic document verification (€ 450)
- Structural & Seismic — physical structural survey (€ 850)
- Renovation Passport — energy upgrade roadmap and grant eligibility documentation (€ 1,250)
- Complete Protection Bundle — all three services in a single coordinated visit (€ 2,040)
- Gas Safety Inspection — mandatory DL 97/2017 cycle, every 5 years (€ 120)
- Energy Performance Certificate — mandatory SCE / DL 101-D/2020, valid 10 years (€ 200)
- Electrical Inspection — RTIEBT periodic inspection, every 6 years (€ 150)
- Moisture Inspection — thermographic and hygrometric diagnosis (€ 250)
- Acoustic Certification — RRAE DL 96/2008 (€ 350)
- HVAC Inspection — heating, ventilation and air conditioning systems (€ 200)
Prices may be updated without notice. The price confirmed at the time of booking applies to that specific booking.
3. Booking Process
Bookings are placed via our website or by email. A booking is not confirmed until you receive written confirmation from InspectOS (typically within 2 business hours of your request). We aim to schedule inspections within 5 business days of confirmation, subject to availability.
To complete your booking you must provide: (a) your full name and contact details; (b) the full property address and type; (c) the estimated year of construction, where known; and (d) any access instructions or relevant restrictions.
4. Fees and Payment
All published prices include VAT at the applicable Portuguese rate. Following booking confirmation, InspectOS sends a payment link by email. Payment is due within 48 hours of receiving that link and, in any case, before the inspection takes place.
We accept payment by bank transfer and major debit/credit cards. Electronic receipts are issued for all payments. InspectOS does not store full card details — payments are processed by a PCI-DSS certified payment provider.
5. Cancellations and Rescheduling
You may cancel or reschedule your inspection subject to the following policy:
- More than 48 hours before the scheduled inspection: full refund or free rescheduling.
- Between 24 and 48 hours before the inspection: 50% refund; rescheduling available once at no cost.
- Fewer than 24 hours before the inspection: no refund. Rescheduling incurs a €50 administration fee.
If InspectOS is unable to carry out the inspection due to access being denied by the owner, or circumstances outside your reasonable control, we will reschedule at no additional charge.
6. Inspection Scope and Limitations
InspectOS inspections are visual and non-destructive assessments carried out at a specific point in time. We do not remove finishes, open walls, drill surfaces, or undertake any invasive investigation unless expressly agreed in writing before the inspection date.
Our reports reflect the condition of the property as observed on the day of inspection. They do not constitute a warranty or guarantee about future performance, nor do they cover defects that are hidden, inaccessible, or not reasonably discoverable through visual inspection alone.
In particular, our inspections do not cover:
- Areas that are inaccessible, locked, or obscured by furniture, equipment, or building materials.
- Underground services, drainage systems, septic tanks, or buried infrastructure (unless engaged as a specific separate service).
- Biological hazards such as asbestos, lead paint, or radon (unless engaged as a specific separate service).
- Legal title, boundary disputes, easements, or planning history beyond the documentary review included in the Simplex Safe service.
- Market value appraisal — our reports address technical and regulatory compliance, not financial valuation.
The Simplex Safe service includes a documentary review of the Caderneta Predial and Certidão Permanente but does not constitute legal advice. For legal matters, we recommend consulting a qualified lawyer (advogado) or solicitor (solicitador).
7. Reports and Deliverables
Inspection reports are delivered in PDF format to the email address provided at booking, normally within 48 hours of the inspection. Where third-party laboratory results are required (e.g., acoustic measurements, air quality testing), delivery may take up to 5 working days.
Reports are prepared in Portuguese. An English executive summary is included in all services. Full English-language reports are available on request for an additional €50.
InspectOS retains copies of all inspection reports for 10 years in accordance with Portuguese building law requirements.
8. Inspector Credentials
All InspectOS inspections are carried out by qualified professionals holding the legally required certifications:
- Structural and seismic assessment: civil engineers with LNEC certification and Eurocode 8 training.
- Energy performance: ADENE-certified Peritos Qualificados (PQ).
- Gas safety: DGEG-authorised technicians.
- Electrical inspections: CERTIEL/LNEC-qualified electricians.
- Moisture diagnosis: technicians qualified in infrared thermography (Level II).
InspectOS carries professional indemnity insurance covering all inspection activities. Certificates of insurance are available on request.
9. Client Obligations
You agree to:
- Provide accurate and complete information about the property, including any known or suspected defects.
- Ensure that the inspector has safe and unobstructed access to all relevant areas of the property for the full duration of the inspection.
- Obtain any necessary consents from the property owner, tenant, or agent if you are not the owner.
- Notify us of any health and safety hazards present at the property before the inspection date.
- Not interfere with the inspection process or pressure the inspector to alter technical findings.
10. Prohibited Uses
You may not use InspectOS services or reports to:
- Misrepresent the condition of a property to any third party (buyers, tenants, insurers, or lenders).
- Provide a report to a party adverse to you in litigation without our prior written consent.
- Redistribute, resell, or commercially exploit reports without a separate written agreement with InspectOS.
- Engage in any unlawful or fraudulent activity under Portuguese law.
11. Intellectual Property
InspectOS retains all intellectual property rights in its inspection methodologies, scoring systems (including the Simplex Risk Score), BIM models, and digital products. Your inspection report is licensed to you for personal and business use in connection with the inspected property. You may share it with advisers, financiers, and counterparties in a property transaction, but may not commercialise it or use it in relation to any other property.
12. Limitation of Liability
InspectOS's total liability to you for any claim arising from or in connection with our services (whether in contract, tort, or otherwise) is limited to the fee actually paid for the specific service giving rise to the claim.
We are not liable for: (a) indirect, consequential, or economic loss; (b) loss of profit, revenue, or anticipated savings; (c) any loss arising from defects that were hidden, inaccessible, or not reasonably discoverable through non-destructive visual inspection.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other matter that cannot be excluded under applicable Portuguese law.
13. Consumer Dispute Resolution
If you are a consumer (a natural person acting outside a trade, business, craft, or profession), you have the right to submit a complaint to an alternative dispute resolution (ADR) entity, pursuant to Lei n.º 144/2015.
InspectOS is committed to using the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC) for consumer disputes. The EU online dispute resolution platform is available at ec.europa.eu/consumers/odr. The Portuguese national consumer portal is at www.consumidor.gov.pt.
14. Governing Law and Jurisdiction
These Terms are governed exclusively by Portuguese law. Without prejudice to rights conferred on consumers by mandatory legislation, any dispute not resolved through the ADR process shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal.
15. Amendments
InspectOS may update these Terms at any time. Where the change is material, we will provide at least 30 days' advance notice by email to the address on record and/or by posting a prominent notice on our website. Continued use of our services after the effective date of the revised Terms constitutes acceptance of the new terms.
