Rising damp climbs through the base of solid masonry and granite walls by capillarity, the classic defect of pre-1951 construction in the north. Infiltration enters from outside: failed roof membranes, cracked terraces, degraded window seals and saturated façades. Since 1 January 2024, DL 10/2024 has removed the municipal verification step that used to sit before a Portuguese property sale. No public authority now checks the condition of what you are buying. Whatever crosses the deed, crosses it with the property, and the buyer's remedies afterwards run through the hidden defects (vícios ocultos) regime of the Civil Code.

Art. 913.º gives a buyer whose property has a concealed defect four routes: repair, price reduction, annulment of the contract where the defect is serious, or damages where the seller knew and concealed in bad faith. The deadlines are unforgiving. Notice of the defect (denúncia) must reach the seller within 1 year of discovery (Arts. 916.º and 1225.º). A 30-day deadline circulates online and confuses buyers. That figure is real but belongs to a different regime: Art. 1220.º governs works commissioned from a contractor (empreitada). A buyer of an existing home sits under the purchase-and-sale rules, and the 1 year, 6 months and 5-year chain above is the one that applies.

The harder problem is proof. Art. 342.º puts the burden on whoever invokes the right, which means the buyer must show the damp existed before the sale and was concealed. Fresh paint dries, seasons change, and eight months after the escritura a wet wall reads as the new owner's maintenance failure. A dated engineer's report from before the purchase is the instrument that settles the question. Without one, most claims never leave the starting line.


When should you order a damp survey in the buying process?

The survey belongs before the CPCV, because the sinal paid at signing is forfeited if the buyer withdraws after the contract binds.

The promissory purchase contract (CPCV, Contrato-Promessa de Compra e Venda) is the point of no return in a Portuguese purchase. The sinal moves at signing, and Art. 442.º sets the exit price: a buyer who withdraws loses the sinal, and a seller who withdraws returns it doubled.
